Terms and Conditions
1. Acceptance of These Terms
Welcome to the Luz + Land website (the “Site”), operated by Flow Real Estate, Inc., doing business as Luz + Land (“Luz + Land,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including property listings, search tools, saved properties, account features, contact forms, showing and consultation requests, newsletters, and related services.
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
2. Informational Purpose; No Professional Relationship
The Site provides general real estate information and tools. Content on the Site is not legal, tax, financial, insurance, appraisal, engineering, environmental, or other professional advice. You should consult qualified professionals regarding your particular circumstances.
Using the Site, creating an account, requesting information, or communicating with Luz + Land does not by itself create a broker-client, agent-client, fiduciary, or other professional relationship. Any real estate representation must be established through a separate written agreement signed by the applicable parties.
3. Property Listings and Real Estate Information
Property information may be supplied by sellers, property owners, multiple listing services (“MLS”), Internet Data Exchange (“IDX”) feeds, public records, brokers, agents, and other third parties. Although we strive to provide useful information, listing details may be incomplete, inaccurate, delayed, changed, withdrawn, sold, leased, or otherwise unavailable without notice.
All information—including price, availability, acreage, boundaries, square footage, permitted uses, zoning, schools, utilities, improvements, taxes, assessments, environmental conditions, and other property characteristics—must be independently verified by you and your chosen professionals. Images, maps, boundary lines, renderings, floor plans, and measurements are illustrative unless expressly stated otherwise and should not be relied upon as surveys or guarantees.
Nothing on the Site constitutes an offer to sell or lease real property. Any transaction is subject to applicable agreements, disclosures, inspections, investigations, financing, and law.
4. Fair Housing and Equal Opportunity
Luz + Land supports the principles of the Fair Housing Act and equal opportunity. We provide services without discrimination based on any characteristic protected by federal, California, or applicable local law.
5. Accounts and Saved Properties
Some Site features may allow you to create an account, save properties, save searches, or receive alerts. You agree to:
provide accurate and current information;
maintain the confidentiality of your login credentials;
promptly notify us of suspected unauthorized access; and
accept responsibility for activity occurring through your account to the extent permitted by law.
We may suspend or terminate an account that violates these Terms, threatens Site security, or is used unlawfully. Saved listings and searches are conveniences only; they may be modified or removed when listing data changes or becomes unavailable.
6. Showing and Consultation Requests
A showing or consultation request is not confirmed until Luz + Land or an authorized representative expressly confirms it. Access may be subject to seller instructions, property availability, identity verification, safety requirements, proof of funds or financing, agency disclosures, and other lawful conditions.
Do not enter, access, photograph, record, or remain at a property without authorization. Follow all instructions provided by the listing agent, property owner, access system, or other authorized representative.
7. Email, Telephone, and Text Communications
When you provide contact information, you authorize us to respond to your request using the contact methods you provide. If you separately opt in to marketing communications, you may receive newsletters, listing updates, market information, or promotional messages.
You may unsubscribe from marketing emails using the link in the message. You may opt out of marketing text messages by replying STOP. For help with texts, reply HELP or contact team@luzandland.com. Message and data rates may apply, and message frequency may vary. Consent to receive marketing calls or texts is not a condition of purchasing property or services. Opting out of marketing does not prevent non-marketing communications that are necessary to respond to a request, administer an account, or facilitate a transaction, where permitted by law.
8. Permitted Use
You may use the Site only for lawful, personal, and legitimate real estate-related purposes. You may not:
violate any law or another person’s rights;
scrape, harvest, copy, republish, or commercially exploit listings or Site content except as expressly permitted;
use automated systems to access the Site in a manner that burdens or disrupts it;
attempt to bypass security, access controls, or usage limits;
introduce malware or harmful code;
impersonate another person or submit false information;
use listing information for unsolicited marketing, discrimination, or unlawful profiling; or
interfere with the Site, its providers, or other users.
9. Intellectual Property
The Site and its original content, branding, design, text, graphics, photographs, video, software, and other materials are owned by or licensed to Luz + Land and are protected by intellectual property laws. MLS, IDX, brokerage, photographer, map, and other third-party materials remain the property of their respective owners and may be subject to additional terms.
We grant you a limited, revocable, nonexclusive, nontransferable license to use the Site for its intended purpose. No other rights are granted.
10. Third-Party Services and Links
The Site may integrate or link to MLS/IDX systems, maps, analytics, account tools, scheduling services, social networks, lenders, title or escrow providers, inspectors, and other third parties. We do not control and are not responsible for third-party sites, services, content, availability, security, or privacy practices. Your use of a third-party service may be governed by separate terms and policies.
A link or reference does not necessarily imply endorsement, affiliation, or a guarantee of the third party’s services.
11. User Submissions
If you submit inquiries, messages, feedback, reviews, images, documents, or other content, you represent that you have the right to provide it and that it does not violate law or another person’s rights. You grant us a nonexclusive right to use your submission as reasonably necessary to respond to you, provide requested services, operate the Site, protect our rights, and comply with law. This section does not change the treatment of personal information described in our Privacy Policy.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” Luz + Land disclaims all warranties, express or implied, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, and noninfringement.
We do not warrant that the Site will be uninterrupted, secure, error-free, or free from harmful components, or that listings, saved searches, alerts, messages, or other content will always be accurate or available. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
13. Limitation of Liability
To the fullest extent permitted by law, Flow Real Estate, Inc., Luz + Land, and their officers, directors, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, or business interruption arising from or related to the Site.
To the fullest extent permitted by law, our aggregate liability for claims arising from or related to the Site will not exceed the greater of (a) the amount you paid us, if any, specifically for use of the Site during the twelve months before the event giving rise to the claim or (b) one hundred U.S. dollars ($100).
These limitations do not exclude liability that cannot lawfully be excluded or limited, and they do not alter duties or remedies arising under a separate signed real estate services agreement.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Flow Real Estate, Inc., Luz + Land, and their officers, directors, employees, agents, licensors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, your material violation of these Terms, or your violation of another person’s rights.
15. Changes and Availability
We may modify, suspend, or discontinue any portion of the Site at any time. We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively when posted unless otherwise stated or required by law. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Unless applicable law requires otherwise, any court proceeding arising from these Terms or the Site must be brought in a state or federal court located in the California county where Flow Real Estate, Inc. maintains its principal place of business, and each party consents to that venue and jurisdiction.
17. Miscellaneous
If a provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, asset transfer, or similar transaction. These Terms and the Privacy Policy constitute the agreement regarding use of the Site, except where a separate written agreement applies.
